Please read these Terms and Conditions («T&C») before start using our website («Website»).
 
1. GENERAL
 
1.1. The following terms and definitions are used in these T&C and should be applicable to all relationships that arise from it:
1.1.1. . «Website Administration» – Website’s employees having direct involvement to Website’s functioning and content, commissioned to act by the name of WSA MEDIA LTD, in turn acting on the basis of license granted by the Rightsholder.
1.1.2. «User» – legally capable individual of 18 or more years who has accepted these T&C and is accessing the Website via Internet.
1.1.3. «Website» – world wide web resource accessible by domain www.andreiclub.com, used by Website Administration for commercial purposes under the license granted by the Rightsholder.
1.1.4. «Website Content» – articles, audio and video art works, photographs or data stored and available at website www.andreiclub.com.
1.1.5. «Services» – any services provided by Website Administration to Users in relation to Website.
1.1.6. «T&C» – these Terms and Conditions as might be amended or expanded from time to time.
 
2. ACCEPTANCE
 
2.1. This Website is suitable only for Users of 18 years and older.
2.2. Your use of Services as might be related to the Website provided functionality, including:
• browsing of information materials available on the Website;
• registration and/or authorization on the Website shall be construed as concluding an agreement in accordance with these T&C and articles 435, 437 and 438 of the Civil Code of Russian Federation.
2.3. By use of any aforementioned capabilities for Services provision you thereby confirm that:
2.3.1. You have read these T&C in full from beginning to the end.
2.3.2. You accept all provisions of these T&C in full without any saves or limitations from your part, and shall be obliged to comply with them or cease the use of Services. If you don’t agree with provisions of these T&C or deprived of the right to conclude a deal based on these T&C, you should immediately cease any use of Services.
2.3.3. These T&C or any its part might be amended by Website Administration without any special notice. The new revision of T&C shall be enacted from the moment of its placing on the Website or User’s notification in other suitable form. If you continue use the Website, you confirm your acceptance of such amendments. These T&C shall be always available via link «Terms and Conditions» at the main page of www.andreiclub.com.

 
3. INTELLECTUAL PROPERTY
 
3.1. All content of the Website, including Pictures, Logotypes, Design, Video, Music and related metadata (in combination – «Website Content»), as well as the composition and arrangement of Website Content are protected by laws on copyright, trademarks, patents, trade secrets and other laws and agreements related to intellectual property. You shall refrain from the following activities in respect of the Website and any Website Content and/or its parts: copy, republish, provide via frames or links, loading, transfer, modification, adaptation, making derivative works in print, electronic and/or any other form; rent, lease or lending, selling, transfer of rights, distribution, demonstration, license, sublicense or reengineering. Hereby you agree to not use big data software, robots or other similar methods for capture and retrieval of data or images in respect of Website or Website Content.
3.2. It is prohibited to remove any watermarks and copyright signs placed into Website Content.
 
4. TRADEMARKS
 
4.1. You hereby agree not to use the trademark of Rightsholder or any of its variations including misspellings, as domain name or its part regardless of main domain name, as well as meta-tags, keyword or any other type of program code or data type.
4.2. Under no circumstances you can accept or use any words or logos resembling Rightsholder’s trademark or could be mistaken for it without prior Rightshoder’s written permit.
4.3. Design of the web site andreiclub.ru, including all page headings, graphics, icons of buttons and scripts constitute Rightsholder’s corporate identity, trademark or service mark and cannot be copied, imitated or used in whole or as a part without prior Rightshoder’s written permit.
4.4. All other trademarks, names of products, companies or logotypes used or available on Website are property of their respective owners. Unless explicitly stated otherwise, reference to any products, services, activities or other information in the form of tradename, trademark, name of producer, supplier, etc., shall not be deemed as their approval, sponsorship or recommendation from Website Administration. All responsibility for information in advertising shall be borne by advertisers. WSA MEDIA Ltd. and Website Administration commissioned by it are Website publishers taking full responsibility for materials published but may disagree with opinions stated by Website authors.
4.5. It is prohibited to use trademark, logotype, images or other branded signs of Rightsholder for providing links to andreiclub.com website without prior written permission of the Rightholder.
4.6. It is prohibited to use frames and hotlinks to andreiclub.com website, or any images therein without prior written permission of the Rightholder.
 
5. SERVICES
 
5.1. Services of Website and Website Content («Services») are provided in accordance with these T&C and laws of the Russian Federation. The Website Administration, acting on behalf of WSA MEDIA Ltd and under the publishing contract signed between WSA MEDIA and the Rightsholder, reserves all rights that are not expressly granted under these T&C, but regulated by license agreement. Website Administration at its discretion may change, amend or terminate provision of Services at any time or reason, with or without prior notice. Website Administration provides Services on «as is» and «as available» basis. Website Administration may collect User’s data related to the Services provided.
5.2. Website Administration has the right to provide access to Website Content via Services.
 
6. LIMITED RESPONCIBILITY
 
6.1. Under no circumstances Website Administration shall bear any responsibility for losses, including foregone profits that might be resulting from your access, use or impossibility to use Website as well as your downloading of Website Content, even if the Website Administration or its authorized representative has warned on the possibility of such losses. You use the Website at your own risk. Website Administration is not responsible for any consequences resulting from your access to and use of Website.
6.2. Where legislation does not allow for limitation or exemption from losses, the aforementioned responsibility limits may be amended accordingly.
6.3. Website Administration is hereby disclaims all express or implied warranties that might be related to any Services provided in any time, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement of copyrights and all other warranties that may arise under the law. Without limiting the foregoing, Website Administration does not give any guarantees that:
• (I) Website will meet your requirements;
• (II) access to the Website will be uninterruptable;
• (III) the quality of the Website will meet your expectations; and
• (IV) any errors or imperfections of the Website, Services or content will be corrected;
• (V) that the Website or Services are allowed in your jurisdiction, and that the Website Administration will continue to support any particular feature of the Website Services. To the extent that the responsibility limitations or exemptions do not apply, all applicable express, implied and statutory warranties are limited in duration to 30 (thirty) days after the date of your first use of the Website, and no guarantees can be provided after this period.
 
7. USER RESPONSIBILITIES
 
7.1. When registering and viewing the Website Content all Users are obliged to comply with the provisions of the current legislation of the Russian Federation and these T&C.
7.2. Users are obliged to not share with other Users access to their own personal page or to any information contained therein, if it could lead to a violation of the legislation of Russian Federation and/or these T&C.
 
8. PERSONAL DATA CONFIDENTIALITY
 
8.1. Website Administration recognizes that it is extremely important to respect the secrecy of the information identifying the User, as received over the Internet. 9. LINKS TO EXTERNAL WEBSITES
 
9.1. Please note that if Website Administration provides links from the Website (www.andreiclub.com) to any third party website or permit any third party to provide links from its website to www.andreiclub.com, Website Administration makes no warranties of any kind, either express or implied, and assumes no responsibility for the content and activities of third parties and their websites. Such sites are not subject to the control of the Website Administration, and Website Administration provides and/or permits to place these links only for User’s convenience.
 
10. LIABILITY OF THE PARTIES AND DISPUTE RESOLUTION
 
10.1. Parties are responsible for any failure to perform their obligations under these T&C in accordance with the Russian legislation.
 
11. INFORMATION 18+
 
11.1. The Website may contain resources for users over 18 years old.
11.2. All girls who’s galleries are posted on the Website are 18 or more years.
11.3. Website Administration is not responsible for the possible consequences of using materials from Website for purposes prohibited by the Russian Criminal Code and international law.
11.4. Responsibility for the consequences that were directly or indirectly caused by the use of the information on Website cannot be attributed to the Website Administration and become grounds for its prosecution.
11.5. Website Administration warrants that all information (photos, video and text materials) is presented on the Website without violating anyone's rights.
 
12. RESTRICTION AND TERMINATION OF USE
 
12.1. Website Administration has the right, in its sole discretion to block, restrict, suspend, or terminate your access to the Website, Services and / or Website Content, in whole or in part, at any time and for any reason without prior notice or obligation to you. Any of your actions, which may be regarded by the Website Administration as limiting or preventing the use of the Website or Services by any other person or entity, are strictly prohibited and may result in termination of your access to Website or Services without prior notice.
 
13. JURISDICTION
 
13.1. These T&C shall be governed by and construed in accordance with the Russian legislation. Issues not regulated by these T&C shall be settled in accordance with the Russian legislation. All possible disputes arising from relations governed by these T&C shall be resolved in accordance with the applicable legislation of the Russian Federation, according to the norms of the Russian law.
 
14. OTHER PROVISIONS
 
14.1. The Website is controlled and operated by the Website Administration from its offices in Moscow, Russian Federation. The Website Administration does not claim that the materials contained on Website are appropriate or available for use outside of Russia. Visitors to the site outside the Russian Federation use it on their own initiative and are responsible for their actions in accordance with the laws of the state from whose territory they access the Website. You may not use, export or re-export Website materials, any copies thereof or customized copies in violation of the Russian legislation in the field of exports.
14.2. These T&C are made in Russian and in some cases, can be provided to the User for review in another language. In case of any discrepancies the Russian version of the T&C and the T&C version in another language, the Russian version of the provisions of these T&C shall prevail.
